These Terms and Conditions govern your access to and use of Fixender, including its website, listings, profiles, messaging features, reviews, verification features, and related services.

By accessing or using Fixender, you agree to these Terms and Conditions, together with the Privacy Policy, Cookie Policy, Professional Terms where applicable, and any other policies or guidelines referenced on the platform.

If you do not agree to these Terms and Conditions, you must not use Fixender.

1. About Fixender

Fixender is an online platform that helps connect customers with independent professionals and service providers.

Fixender provides a directory and marketplace-style platform. Fixender is not itself the provider of the services advertised by professionals, and unless expressly stated otherwise, Fixender is not a party to any contract, agreement, booking, quote, or dispute between users.

2. Who may use Fixender

You may use Fixender only if you are at least 18 years old and legally capable of entering into binding agreements.

If you use Fixender on behalf of a business or organisation, you confirm that you are authorised to act on its behalf.

3. Nature of the platform

Fixender allows customers to search for, view, compare, contact, and review independent professionals and service providers.

Fixender does not employ, control, supervise, direct, or manage the professionals listed on the platform. Professionals are independent users of the platform and are solely responsible for their listings, representations, conduct, pricing, services, legal compliance, and dealings with customers.

Fixender does not guarantee:

  • that any professional is suitable for your needs
  • that any listing is complete, accurate, or up to date
  • that any customer enquiry is genuine, suitable, or commercially worthwhile
  • that any service will be performed to a particular standard
  • that any interaction between users will lead to a successful outcome

Users are responsible for carrying out their own checks before entering into any agreement or relying on any information on the platform.

4. Accounts and registration

Some features of Fixender may require registration.

When creating an account, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login details and for all activity carried out through your account unless caused directly by Fixender’s own fault.

You must notify Fixender promptly if you believe your account has been accessed without authorisation.

5. User obligations

When using Fixender, you agree to:

  • provide truthful information
  • use the platform lawfully and in good faith
  • respect other users
  • keep your account and contact details up to date
  • comply with any applicable laws and regulations

You must not:

  • impersonate another person or business
  • submit false, misleading, or deceptive information
  • post unlawful, abusive, discriminatory, defamatory, infringing, or harmful content
  • misuse messaging, review, or reporting tools
  • scrape, harvest, copy, or extract platform data without permission
  • use bots, malware, or automated tools to interfere with the platform
  • attempt to bypass restrictions, suspensions, moderation, or security features

6. Listings, profiles, and content

Users are solely responsible for any content they upload, publish, submit, or display on Fixender, including profile details, listing descriptions, images, credentials, service information, reviews, messages, and documents.

By submitting content to Fixender, you confirm that:

  • you own it or have the right to use it
  • it is accurate to the best of your knowledge
  • it does not violate any law or third-party rights

Fixender may review, moderate, edit, reject, restrict, suspend, unpublish, or remove content where reasonably necessary to protect users, enforce policies, investigate abuse, maintain platform quality, or comply with law.

7. Reviews and ratings

Fixender may allow users to submit reviews, ratings, and feedback.

Reviews must be honest, genuine, relevant, and lawful. Users must not post fake reviews, manipulated reviews, abusive reviews, or reviews intended to mislead others.

Fixender may investigate, delay, restrict, remove, or refuse to publish reviews where it reasonably believes there may be fraud, abuse, manipulation, impersonation, irrelevance, or other policy breaches.

Fixender is not obliged to publish every review submitted.

8. Verification and badges

Fixender may offer badges, verification features, trust indicators, or similar status labels for some users or listings.

Any verification, badge, trust mark, or profile status shown on Fixender is for general informational purposes only.

It does not mean that Fixender:

  • guarantees identity beyond the checks actually carried out
  • guarantees quality, safety, legality, or suitability
  • continuously monitors compliance, licences, qualifications, or insurance
  • endorses or recommends any user or business

Verification may be limited, partial, point-in-time only, dependent on submitted information, and subject to change, expiry, withdrawal, or error.

Verification documents and related submissions may be stored and reviewed by Fixender and authorised service providers for verification, trust and safety, fraud prevention, complaint handling, and compliance purposes.

9. Messaging, attachments, and communications

Fixender may provide messaging, enquiry, or communication features between users, including the ability to send text, files, images, or other attachments through the platform.

Users are solely responsible for the content they send. Users must not send unlawful, abusive, infringing, deceptive, harmful, or confidential material they are not authorised to share.

Fixender may store, process, review, restrict, or disclose messages and attachments where reasonably necessary to operate the platform, investigate complaints or reports, prevent fraud or abuse, protect users, enforce these Terms, or comply with legal obligations.

10. Customer-professional relationships

Any contract for services is between the customer and the professional, not with Fixender, unless Fixender expressly states otherwise in writing.

Fixender is not responsible for:

  • quotes or prices
  • quality of work
  • timelines or delays
  • cancellations
  • payment disputes
  • defective work
  • warranties or aftercare
  • misconduct, injury, loss, or damage arising from user interactions

Users are solely responsible for agreeing and documenting the terms of any services they arrange.

11. No endorsement

Listing a professional, displaying a badge, showing a review, or allowing a profile to appear in search results does not mean that Fixender endorses, recommends, certifies, guarantees, or approves that person or business.

A listing, badge, search ranking, review, or profile appearance on Fixender does not mean that Fixender has approved, guaranteed, continuously monitored, or recommended that user or business.

12. Use of personal data between users

Users who obtain personal data through Fixender, including contact details, addresses, messages, photos, or job information, may only use that data for legitimate purposes related to the relevant enquiry, service, transaction, or platform use.

Users must not:

  • sell, misuse, or unlawfully share such data
  • use it for unrelated marketing without proper legal basis where required
  • scrape, harvest, or build unauthorised databases from it
  • retain it longer than reasonably necessary for the relevant purpose

Each user remains independently responsible for complying with applicable privacy and data protection laws.

13. Intellectual property

All rights in the Fixender platform, including its design, branding, layout, software, text, and platform content, belong to Fixender or its licensors unless otherwise stated.

You may not copy, reproduce, distribute, modify, reverse engineer, republish, or commercially exploit any part of the platform without permission, except as allowed by law.

Users retain ownership of their own submitted content, but by submitting content to Fixender, they grant Fixender a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, publish, display, distribute, translate, promote, moderate, and use that content for the operation, improvement, protection, and marketing of the platform.

14. Suspension and removal

Fixender may suspend, restrict, limit, unpublish, or remove accounts, listings, content, reviews, badges, or access to features where it reasonably believes that:

  • these Terms or other platform policies have been breached
  • information is false, misleading, outdated, or incomplete
  • a user presents legal, fraud, safety, reputational, or security risks
  • action is necessary to protect users or comply with law

Fixender may investigate and request further information before taking action, but it is not required to do so in every case.

15. Availability of the platform

Fixender aims to keep the platform available and functioning properly, but does not guarantee uninterrupted access, error-free operation, or permanent availability of any feature.

Features may be added, changed, suspended, or withdrawn at any time.

16. Disclaimer

To the fullest extent permitted by applicable law, Fixender provides the platform on an “as is” and “as available” basis without guarantees, warranties, or representations of any kind except where such exclusions are not permitted by law.

17. Liability

To the fullest extent permitted by applicable law, Fixender is not liable for:

  • acts, omissions, or conduct of users
  • service quality, safety, legality, or performance
  • inaccurate, incomplete, deceptive, or outdated listings or content
  • fraudulent or low-quality enquiries
  • disputes between users
  • loss of profits, revenue, business opportunity, goodwill, or expected savings
  • indirect, incidental, special, consequential, exemplary, or punitive losses
  • downtime, interruptions, data loss, or technical failures not caused by Fixender’s wilful misconduct

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.

18. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold harmless Fixender and its operators, affiliates, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising out of or connected with:

  • your use of the platform
  • your content
  • your breach of these Terms
  • your breach of law
  • your infringement of third-party rights
  • your interactions or disputes with other users

19. Changes to these Terms

Fixender may update these Terms and Conditions from time to time.

Where legally required or reasonably appropriate, the updated version will be published on the platform and may also be notified through the site or by email.

Your continued use of Fixender after the updated Terms take effect means you accept the revised version.

20. Governing law and dispute resolution

These Terms and Conditions are governed by the laws specified by Fixender in its legal notices, except where mandatory local law requires otherwise.

Any dispute arising out of or in connection with these Terms and Conditions shall be handled in accordance with the dispute, jurisdiction, or governing law provisions indicated by Fixender, unless mandatory local law provides otherwise.

If any provision is found invalid or unenforceable in a particular jurisdiction, it shall be interpreted or limited to the minimum extent necessary, and the remainder shall remain in full force.
