Terms and Conditions

1. Acceptance

Access to fixender.com implies acceptance of these Terms and Conditions, the Legal Notice, the Privacy Policy and the Cookie Policy. Registration as a User or Professional implies express acceptance of these Terms.

2. Definitions

  • Fixender: fixender.com, owned by Gaspar García Sánchis (Spanish Tax ID 44946948H).
  • User: natural or legal person accessing the site to find professionals.
  • Professional: natural person (self-employed) or company providing home services in Spain and listed on the site.
  • Listing: the set of professional data published about a Professional.

3. Nature of the service

Fixender is an online directory for informational purposes. Fixender does not provide the advertised services, does not participate in the contracting between User and Professional and does not receive any commission for such contracting. The contractual relationship for service delivery is established directly and exclusively between User and Professional.

Fixender acts as an intermediary service provider under articles 13 to 17 of LSSI-CE.

4. User registration and obligations

User registration is free of charge. The User undertakes to:

  • Provide truthful and up-to-date information.
  • Maintain the confidentiality of credentials.
  • Not use the site for unlawful, fraudulent or harmful purposes.
  • Refrain from massively extracting or reusing site content by automated means (scraping) without express written authorisation.

5. Listing publication and Professional obligations

5.1. Ways of being added to the directory

  1. Pre-publication from public sources. Fixender may create listings from professional data obtained from publicly accessible sources (Google Maps, the Professional’s own website, public registries). The Professional is informed of the publication by letter, email or WhatsApp within a maximum of 30 days from data collection, in accordance with art. 14 GDPR.
  2. Listing claim by the Professional via the channel indicated in their letter or via the web form.
  3. Direct registration at the Professional’s initiative.

5.2. Professional commitments

By claiming or creating a Listing, the Professional declares and warrants that:

  • They are the legitimate holder of the activity described and hold the necessary permits and licences to perform it in Spain.
  • The information provided is truthful, current and not misleading.
  • They have the consent of third parties whose data may appear in the Listing (e.g. photographs, testimonials).
  • They comply with applicable tax, labour and administrative regulations.

5.3. Right to object and removal

The Professional may request modification or removal of their Listing at any time:

Removal is processed within a maximum of 72 hours. After removal, data is kept in blocked form for one year for defence against possible claims (LOPDGDD art. 32).

6. User-generated content (reviews and ratings)

Where the site enables reviews, these are published under the author’s responsibility. Fixender reserves the right to moderate, remove or refuse reviews that breach these Terms, applicable law or third-party rights, in particular:

  • Defamatory, insulting or honour-infringing content.
  • False, manipulated or undisclosed paid reviews (art. 26 Spanish Unfair Competition Law).
  • Third-party personal information without consent.
  • Spam, undisclosed advertising or off-topic content.

The Professional has the right of reply to reviews referring to their activity.

7. Notice and action for unlawful content (DSA)

In accordance with article 16 of Regulation (EU) 2022/2065 (Digital Services Act), any person may report allegedly unlawful content hosted on the site through the procedure described at fixender.com/notice-and-action/. Fixender will respond in a reasoned and diligent manner, without undue delay.

8. Limitation of liability

Within the limits permitted by applicable law, Fixender shall not be liable for:

  • The quality, suitability, legality or outcome of services provided by Professionals.
  • Damages arising from inaccurate or outdated information in Listings, without prejudice to the rectification mechanism provided.
  • Service interruptions due to technical reasons, force majeure or hosting/network providers.

9. Intellectual property

Original site content is protected by intellectual property law. Reproduction, distribution, public communication or transformation without authorisation is prohibited. The trademark “Fixender” is owned by Gaspar García Sánchis.

11. Changes

Fixender may amend these Terms to reflect regulatory or service changes. Substantial changes will be notified to registered users at least 15 days in advance. Use of the site after the effective date of the amendments implies their acceptance.

12. Dispute resolution

Consumer Users may access the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

13. Governing law and jurisdiction

These Terms are governed by Spanish law. For disputes where the User is a consumer, the Courts of the User’s place of residence shall have jurisdiction. In all other cases, the parties submit to the Courts of Valencia.
