This Privacy Policy explains how Fixender collects, uses, stores, shares, and protects personal data when you use the Fixender platform. Our processing is based on one or more of the lawful bases described in section 5 below, including the performance of our agreement with you (our Terms), our legitimate interests in operating a safe and functioning platform, our legal obligations, and your consent where specifically requested (for example, before uploading verification documents).

1. About this Privacy Policy

Fixender is an online platform that connects customers with independent professionals and service providers.

This Privacy Policy applies to personal data collected through the Fixender website, user accounts, listings, messaging features, reviews, verification processes, support communications, and related platform features.

  • support requests, reports, complaints, and moderation information

3. How we collect personal data

We may collect personal data:

  • directly from you when you register, create a listing, fill in forms, send messages, request support, or upload documents
  • from your use of the platform and your device
  • from communications between users through Fixender
  • from reviews, complaints, reports, or moderation processes
  • from verification submissions
  • from cookies and similar technologies
  • from third-party services integrated into the platform where applicable

4. How we use personal data

We may use personal data to:

  • create and manage accounts
  • operate the platform and provide its features
  • display listings, profiles, and public-facing content
  • enable communication between customers and professionals
  • process and manage reviews, ratings, reports, and disputes

  • enforce our Terms, policies, and platform rules

5. Lawful bases for processing

Where required by applicable law, Fixender processes personal data on one or more of the following bases:

  • performance of a contract or steps taken at your request before entering into a contract
  • legitimate interests, including operating, improving, securing, and protecting the platform
  • compliance with legal obligations
  • consent, where required
  • establishment, exercise, or defence of legal claims where applicable

6. Public information

Some information may be visible to other users or the public, including:

  • professional listing details
  • business description
  • service categories
  • service areas
  • profile images or business images
  • reviews, ratings, and related content
  • badges or verification status where shown

Users should avoid including unnecessary sensitive or confidential information in public-facing fields.

7. Verification data

What we may request. To offer a verified status on the platform, we may ask you to upload supporting documents such as national identity documents (DNI, NIE, or passport), proof of address, business registration, professional licences, qualification certificates, or insurance documentation.

Purpose. We process these documents only to verify your identity or professional credentials for the purpose of granting a verified status, to prevent fraud and impersonation on the platform, and to comply with legal and regulatory obligations. We do not use verification documents for marketing or any other purpose.

Lawful basis. The lawful basis for processing verification documents, which may include special categories of data under Article 9 GDPR, is your explicit consent (GDPR Article 6(1)(a) and, where applicable, Article 9(2)(a)). Consent is recorded via an unticked checkbox on the upload form before you submit your documents; we retain a record of this consent (timestamp, anonymised IP, user-agent) as evidence of lawful processing.

Security and access. Verification documents are stored in a private folder that is not accessible over the public web, protected by server-level access controls. Access is restricted to authorised reviewers, and each access is logged for audit purposes. Documents are never made public and are not shared with other users.

Retention. Verification documents are automatically deleted within 30 days of the verification decision (approved or rejected), unless a legal obligation or an active fraud/safety investigation requires a longer retention period. A record of the outcome, the decision date, and evidence of your consent is kept separately to demonstrate compliance; this record does not contain the documents themselves.

Withdrawal of consent. You may withdraw your consent at any time by contacting support@fixender.com. Withdrawal will result in the removal of your verified status and the secure deletion of any documents we still hold, subject to any legal retention obligation.

For further detail, please see our Verification Policy.

8. Messages, reviews, and reports

Fixender may process the content of messages, reviews, support requests, reports, complaints, and moderation records in order to:

  • operate communication features
  • investigate misuse, fraud, or harmful conduct
  • enforce Terms and policies
  • protect users and the platform
  • respond to disputes or legal issues

This may include the processing of attached files, images, timestamps, moderation records, and related metadata.

9. Cookies and similar technologies

Fixender may use cookies and similar technologies to operate the website, remember preferences, improve performance, support language or interface settings, analyse usage, and maintain security.

Please see the Cookie Policy for more information.

10. Sharing personal data

Fixender may share personal data:

  • with other users where this is part of the platform’s function, such as when customers and professionals contact each other
  • with service providers that help operate, host, secure, maintain, or improve the platform
  • with analytics, communications, translation, localisation, language-support, verification, or support tools where applicable
  • with legal advisers, insurers, auditors, or professional advisers where reasonably necessary
  • with authorities, regulators, courts, or law enforcement where legally required or reasonably necessary
  • in connection with a complaint, dispute, fraud investigation, or safety issue
  • in connection with a reorganisation, sale, transfer, or restructuring of the platform if ever applicable

Fixender does not sell personal data as a business model.

11. International data transfers

Because Fixender may use service providers or technical systems in different countries, personal data may be processed in countries other than the one in which you are located.

This may include service providers involved in hosting, messaging, moderation, security, translation, analytics, verification, or technical support.

Where required by applicable law, Fixender will take reasonable steps to ensure that appropriate safeguards are used for such transfers.

12. Data retention

Fixender keeps personal data only for as long as reasonably necessary for the purposes described in this Privacy Policy, including platform operation, user support, dispute handling, fraud prevention, legal compliance, and record-keeping.

Retention periods may vary depending on the type of data, including:

  • account information
  • listing content
  • messages and enquiry records
  • reviews and ratings
  • support and moderation records
  • verification documents
  • technical logs and security records

When data is no longer reasonably needed, it will be deleted, anonymised, or securely retained only where required by law or for legitimate legal, safety, or compliance reasons.

13. Data security

Fixender takes reasonable technical and organisational measures to protect personal data against unauthorised access, loss, misuse, alteration, or disclosure.

However, no system can be guaranteed to be completely secure, and users are also responsible for protecting their own accounts, devices, and credentials.

14. Your rights

Depending on the laws that apply to you, you may have rights such as:

  • access to your personal data
  • correction of inaccurate data
  • deletion of personal data
  • restriction of processing
  • objection to certain processing
  • data portability
  • withdrawal of consent where processing is based on consent
  • complaint to a relevant supervisory or regulatory authority

These rights are not absolute and may be subject to legal exceptions. To exercise any of them, please contact us at support@fixender.com. We will respond within the time limits set by applicable data-protection law.

If you believe your data-protection rights have been infringed, you also have the right to lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, AEPD), whose website is www.aepd.es.

Data Protection Officer. Fixender has assessed the triggers for appointing a Data Protection Officer (DPO) under Article 37 GDPR and considers that none currently apply: the service is operated individually, without commercial purpose, and does not conduct large-scale systematic monitoring or large-scale processing of special-category data as its core activity. No DPO has therefore been appointed. For any data-protection question you may contact us directly at support@fixender.com.

15. Children

Fixender is not intended for use by children. Users must be at least 18 years old to use the platform.

16. Changes to this Privacy Policy

Fixender may update this Privacy Policy from time to time.

Where legally required or reasonably appropriate, the updated version will be published on the platform and may also be notified through the site or by email.
