Professional Terms

These Professional Terms govern the use of Fixender by professionals, tradespeople, contractors, companies, service providers, and other business users who create, claim, manage, advertise, or operate a professional profile, listing, or account on Fixender.
By registering as a professional, creating or claiming a listing, submitting business information, using professional features, or continuing to use Fixender as a professional, you agree to these Professional Terms, together with Fixender’s Terms and Conditions, Privacy Policy, Cookie Policy, and any other policies or guidelines referenced on the platform.
If you do not agree to these Professional Terms, you must not use Fixender as a professional.
0. About Fixender
Fixender is an online platform that connects customers with independent professionals and service providers.
Fixender is not the provider of the services advertised by professionals on the platform. Fixender does not employ, supervise, control, or direct professionals, and is not a party to any contract, quotation, arrangement, booking, or dispute between a customer and a professional unless expressly stated otherwise in writing.
Professionals remain solely responsible for the services they offer, the information they publish, and their dealings with customers.
1. Who these terms apply to
These Professional Terms apply to any person or business using Fixender for business or commercial purposes, including any person who:
- creates or manages a professional account
- creates, edits, or claims a professional listing
- advertises services through Fixender
- receives customer enquiries through Fixender
- uses any paid, premium, promotional, messaging, or lead-generation feature made available to professionals
If you use Fixender on behalf of a company, partnership, or other organisation, you confirm that you are authorised to bind that entity to these Professional Terms.
2. Independent professional status
By using Fixender as a professional, you confirm that:
- you are acting as an independent service provider or business
- you are not an employee, worker, agent, franchisee, partner, or representative of Fixender
- you are solely responsible for how you provide your services
- you are solely responsible for your business operations, staff, subcontractors, taxes, invoices, permits, insurance, and legal or regulatory compliance
Nothing in these Professional Terms creates any employment, agency, partnership, joint venture, representative, or exclusive relationship between you and Fixender.
3. Eligibility and compliance
You may only use Fixender as a professional if:
- you are at least 18 years old
- you have legal capacity to enter into binding agreements
- you provide truthful and complete registration information
- you are legally permitted to offer the services you advertise
- you maintain any licences, registrations, qualifications, certifications, permits, approvals, or insurance required in the places where you operate
You are solely responsible for understanding and complying with all laws, regulations, standards, codes, tax rules, licensing rules, advertising rules, consumer rules, and professional obligations that apply to your services in each country, region, or locality in which you operate.
4. Account registration and security
You are responsible for maintaining the confidentiality and security of your account, login credentials, and any device used to access Fixender.
You must:
- keep your account information accurate and up to date
- use a secure password and take reasonable steps to prevent unauthorised access
- notify Fixender promptly if you suspect unauthorised use of your account
- ensure that anyone accessing your account on your behalf is properly authorised
You are responsible for all activity carried out through your account unless caused directly by Fixender’s own fault.
5. Listings and profile information
You are solely responsible for the content of your listing, profile, business description, service categories, contact details, service area, images, credentials, pricing information, and any other material you submit to Fixender.
You must ensure that all information you provide is:
- accurate
- complete
- not misleading
- kept up to date
- lawful to publish
- genuinely connected to your business and services
You must not:
- impersonate another person or business
- create false, deceptive, or duplicate listings
- misrepresent your location, qualifications, experience, availability, business status, or identity
- use misleading titles, testimonials, affiliations, or images
- falsely claim to be licensed, accredited, insured, approved, or endorsed
Fixender may edit, moderate, reject, suspend, unpublish, limit, or remove listings or content where reasonably necessary to protect users, maintain platform quality, investigate abuse, enforce policies, or comply with law or regulatory obligations.
6. Professional responsibilities
As a professional using Fixender, you are solely responsible for:
- the services you advertise and provide
- the truthfulness of your representations to customers
- the quality, legality, safety, timing, and completion of your work
- setting and communicating your own prices, quotes, estimates, and commercial terms
- complying with all applicable legal and regulatory obligations
- obtaining and maintaining appropriate insurance, licences, permits, registrations, and approvals
- managing complaints, callbacks, defects, cancellations, guarantees, warranties, and aftercare relating to your services
Fixender does not guarantee that you will receive enquiries, leads, bookings, work, revenue, or a particular volume or quality of customer contact.
7. Customer contracts and disputes
Any contract for services is between you and the customer, not with Fixender.
Unless Fixender expressly states otherwise in writing:
- Fixender does not set your prices
- Fixender does not supervise, direct, or guarantee your work
- Fixender does not guarantee the accuracy, seriousness, suitability, legality, solvency, or intentions of customer enquiries
- Fixender is not responsible for cancellations, non-payment, defective work, delays, misconduct, misunderstandings, or disputes between you and customers
You are responsible for agreeing directly with the customer on all relevant terms, including scope of work, timing, pricing, payment, access, cancellations, warranties, follow-up work, and any legally required disclosures.
9. Use of customer data
If you receive customer personal data through Fixender, including names, phone numbers, email addresses, physical addresses, job details, photos, messages, or other enquiry information, you may only use that data for legitimate purposes directly connected to the customer’s enquiry or requested service.
You must not:
- sell, rent, misuse, or unlawfully disclose customer data
- use customer data for unrelated marketing unless legally permitted and properly authorised where required
- build your own marketing or contact database from platform enquiries except where lawful and strictly necessary
- scrape, harvest, export, or reuse customer data for unrelated purposes
- contact customers in a misleading, abusive, excessive, harassing, or spam-like manner
- retain customer data longer than reasonably necessary for the enquiry, service, legal, compliance, or dispute purpose for which it was provided
You must take appropriate technical and organisational measures to protect customer data from unauthorised access, misuse, loss, or disclosure.
Professionals must keep devices, accounts, inboxes, and login credentials used in connection with Fixender reasonably secure.
Professionals must notify Fixender without undue delay if they become aware of any suspected misuse, unauthorised access, or personal data breach involving customer data obtained through the platform.
Professionals must not retain customer data longer than reasonably necessary for the relevant enquiry, service, legal, compliance, or dispute purpose, and must stop using or securely delete such data when it is no longer needed, unless retention is required by applicable law.
You remain independently responsible for complying with all applicable privacy and data protection laws in relation to any customer data you receive or process.
10. Confidentiality
You must treat as confidential any non-public information you obtain through Fixender or through customer interactions on the platform, including customer details, enquiry content, access information, pricing discussions, internal platform processes, and any documents shared for a limited purpose.
You must not disclose or use such information except as reasonably necessary to respond to an enquiry, provide a requested service, comply with legal obligations, or protect your legal rights.
This clause does not apply to information that is already public through no fault of your own or that you are legally required to disclose.
11. Staff, subcontractors, and helpers
If a professional allows staff, subcontractors, or other authorised persons to assist with enquiries or services, the professional remains fully responsible for ensuring that those persons comply with these Professional Terms, including confidentiality, lawful data use, and platform rules.
12. Reviews, ratings, and reputation
Reviews and ratings are an important trust feature of Fixender. You must not manipulate them.
You must not:
- post reviews about yourself or your own business
- ask others to post false or misleading reviews
- buy, sell, trade, or incentivise fake reviews
- pressure customers into changing or removing genuine reviews
- submit reviews through fake accounts or undisclosed connected parties
- misuse complaint or takedown processes to suppress honest feedback
Fixender may moderate, investigate, delay, restrict, remove, or decline to publish reviews where it reasonably believes there may be fraud, abuse, manipulation, illegality, irrelevance, impersonation, or policy breaches.
Fixender is not obliged to publish every review submitted.
13. Prohibited conduct
As a professional, you must not:
- break any applicable law or regulation
- provide illegal, unsafe, deceptive, or fraudulent services
- mislead customers or Fixender
- impersonate another person or business
- submit false documents or false information
- harass, threaten, discriminate against, exploit, or abuse customers or other users
- use bots, scraping tools, or automated means to extract platform content or user data without permission
- copy, harvest, or reuse listing or directory data from Fixender without permission
- interfere with the operation, security, or integrity of the platform
- upload malware, harmful code, or malicious content
- circumvent suspensions, restrictions, moderation, or platform controls
- misuse enquiries for spam, cold sales, unrelated promotion, or unlawful solicitation
14. Communications and customer contact
Fixender may send you service-related communications, operational notices, moderation notices, billing notices, security alerts, and account-related messages.
If you receive customer enquiries through Fixender, you are responsible for handling them lawfully, professionally, and in good faith.
Fixender does not guarantee that every enquiry is genuine, complete, suitable, lawful, or commercially worthwhile. You remain responsible for carrying out your own checks before accepting work.
15. Paid services and visibility features
Fixender may offer paid features, subscriptions, promotions, boosts, advertising products, premium placement, or lead-generation tools.
Unless expressly stated otherwise:
- fees relate to access to platform features, visibility, promotion, or lead opportunities
- fees do not guarantee jobs, contracts, customer responses, revenue, or business outcomes
- premium placement does not create an endorsement by Fixender
- Fixender may change, suspend, withdraw, or update features from time to time
If you fail to pay applicable fees when due, Fixender may suspend or restrict access to related features.
16. Intellectual property and content licence
You keep ownership of the content you upload to Fixender, such as logos, descriptions, images, documents, and listing text, to the extent you own it.
By uploading or submitting content to Fixender, you grant Fixender a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, publish, display, distribute, translate, promote, moderate, and use that content for the operation, improvement, protection, and marketing of the platform.
You confirm that:
- you own the content or have the right to use and submit it
- the content does not infringe the rights of any third party
- the content is lawful and not misleading
Fixender may remove or refuse content that it reasonably believes breaches these Professional Terms, the law, platform policy, or the rights of others.
17. Suspension, restriction, and removal
Fixender may suspend, restrict, unpublish, downgrade, flag, limit, or permanently remove your account, listing, content, or access to features where it reasonably believes that:
- you have breached these Professional Terms or other platform policies
- your information is false, misleading, outdated, or incomplete
- you have failed to cooperate with safety checks
- your conduct creates legal, reputational, fraud, trust, safety, or security risks
- complaints, reports, reviews, or other evidence suggest misuse or harmful conduct
- action is necessary to comply with law, court orders, regulator requests, or platform safety obligations
Where appropriate, Fixender may investigate, request information, or allow correction before taking action, but it is not required to do so in every case.
18. Ending your use of Fixender
You may stop using Fixender as a professional at any time by ceasing use of the platform and requesting account closure where applicable.
Ending your use does not automatically remove content, logs, reviews, dispute history, moderation records, transaction records, or data that Fixender is entitled or required to retain for legal, safety, anti-fraud, operational, tax, accounting, or compliance reasons.
19. Liability
To the fullest extent permitted by applicable law, Fixender is not liable for:
- the acts, omissions, conduct, quality, safety, legality, or performance of customers or professionals
- loss of work, lost profits, lost revenue, lost business opportunity, loss of goodwill, or expected savings
- inaccurate, incomplete, fraudulent, abusive, or low-quality enquiries
- platform downtime, delays, interruptions, outages, or technical failures
- unauthorised access caused by your failure to secure your account or systems
- disputes between you and customers
- decisions you make based on customer information, platform content, or reviews
- any indirect, incidental, special, consequential, exemplary, or punitive losses
Nothing in these Professional Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.
20. Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold harmless Fixender, its operators, affiliates, officers, employees, contractors, and service providers from and against claims, losses, liabilities, damages, costs, and expenses, including reasonable legal expenses, arising out of or connected with:
- your services
- your listing content
- your misuse of the platform
- your breach of these Professional Terms
- your breach of applicable law or regulatory obligations
- your infringement of third-party rights
- your misuse of customer data
- disputes between you and customers
21. Changes to these Professional Terms
Fixender may update these Professional Terms from time to time.
Where legally required or reasonably appropriate, Fixender will publish the updated version on the platform and may also notify professionals through the site, dashboard, or email.
Your continued use of Fixender as a professional after updated Professional Terms take effect means you accept the revised version.
22. Relationship with other policies
These Professional Terms apply in addition to Fixender’s general Terms and Conditions, Privacy Policy, Cookie Policy, and any other policy or guideline published on the platform.
If there is a conflict between these Professional Terms and the general Terms and Conditions in relation to professional use, these Professional Terms will prevail to the extent of that conflict.
23. Governing law and dispute resolution
These Professional Terms are governed by the laws specified in Fixender’s main Terms and Conditions, except where mandatory local law requires otherwise.
Any dispute arising out of or in connection with these Professional Terms shall be handled in accordance with the dispute, jurisdiction, or governing law provisions set out in Fixender’s main Terms and Conditions, unless mandatory local law provides otherwise.
If any provision of these Professional Terms is held to be invalid or unenforceable under the law of a particular country or jurisdiction, that provision shall be interpreted or limited to the minimum extent necessary, and the remainder of these Professional Terms shall remain in full force and effect.
